The Thinking Practice

1. Our 30-Day Money Back Guarantee

We are confident in the quality and value of the Thinking Practice Starter Pack. If you are not completely satisfied with your purchase for any reason, we will refund your full purchase price, no questions asked.

 

How to claim:

  • Contact us at hello@thethinkingpractice.com within 30 days of your purchase date

  • Include your name, email address, and order confirmation number

  • We will acknowledge your request within 1 business day

  • Your refund will be processed within 5 business days of approval

  • Refunds are issued to your original payment method

 

That is all that is required. No lengthy explanation. No conditions. No runaround.

 

This guarantee applies to the Starter Pack ($197) only. It does not apply to facilitated session engagements.

2. Your Rights Under Australian Consumer Law

In addition to our 30-Day Money Back Guarantee, the ACL provides you with automatic consumer guarantees that cannot be excluded by any policy or terms. You are entitled to a remedy if a product or service:

  • Is not of acceptable quality, safe, durable, free from defects, and acceptable in appearance

  • Is not fit for the purpose it was described or that you made known to us before purchasing

  • Does not match its description, sample, or demonstration

  • Does not meet any express warranty we have made

 

These statutory rights apply independently of and in addition to our 30-Day Money Back Guarantee. You may choose to rely on either or both.

3. Digital Products (Starter Pack and Downloads)

3.1 The 30-Day Guarantee

As described in Clause 1, you may claim a full refund within 30 days of purchase for any reason. No conditions apply.

 

3.2 Statutory Refund Rights Beyond 30 Days

After the 30-day guarantee period, we will still provide a remedy where your statutory rights under the ACL apply. This includes where:

  • The files cannot be downloaded or accessed, despite reasonable attempts and following our troubleshooting guidance

  • The files are corrupted, incomplete, or do not open correctly

  • The product is materially different from its description on the Website

  • The product contains a serious defect that makes it unfit for its intended purpose

 

3.3 Change of Mind After 30 Days

After the 30-day guarantee period has expired, we are not required under the ACL to provide a refund where you have simply changed your mind, no longer want the product, or purchased by mistake. We encourage you to read the full product description before purchasing and to contact us with any questions before you buy.

 

3.4 Licence After Refund

Upon processing a refund under the 30-Day Money Back Guarantee or any ACL remedy, your licence to use the downloaded materials is revoked. You agree to delete all copies of the downloaded files from your devices.

4. Facilitation Services and Engagements

4.1 Consumer Guarantees for Services

All facilitation services, Design Sessions, and other engagements are delivered with due care and skill, and will be fit for the purpose agreed between us. The 30-Day Money Back Guarantee does not apply to services. However, your ACL rights do.​

 

4.2 Major Failure

A major failure occurs where the service:

  • Is so significantly deficient that a reasonable consumer would not have engaged us had they known

  • Is substantially unfit for purpose and cannot be made fit within a reasonable time

  • Creates an unsafe situation

  • In the event of a major failure, you are entitled to cancel the service agreement and receive a full refund of any amount paid, or to keep the service and seek compensation for the reduction in value.
     

4.3 Minor Failure

For minor failures, issues that do not significantly affect the value or usefulness of the service, we will re-deliver the affected component or provide a partial refund at our discretion, in accordance with the ACL.​
 

4.4 Cancellation by Client

Cancellation of a confirmed engagement by the client is subject to the cancellation terms in the relevant engagement letter. Where no engagement letter exists, the default terms in the Terms and Conditions, Clause 6.2 apply.​
 

4.5 Cancellation by The Thinking Practice

If we cancel a confirmed engagement due to circumstances within our control, we will provide a full refund of any deposit or fees paid and will make reasonable efforts to reschedule.

5. Free Resources

Free resources, including the Execution Architecture Canvas are provided at no cost. The 30-Day Money Back Guarantee and this Refund Policy do not apply to free resources. If you experience difficulty accessing a free resource, please contact us and we will assist promptly.

6. How to Request a Refund

For the 30-Day Money Back Guarantee or any other refund request, contact us with:

  • Your full name and email address used for the purchase

  • Your order confirmation number

  • Whether you are claiming under the 30-Day Guarantee or for another reason

  • Any supporting information if relevant (e.g. screenshots of technical issues)
